1. Acceptance of Terms

By accessing or using the Botomic service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Botomic Limited ("Botomic," "we," "our," or "us"), a company registered in the United Kingdom.

2. Description of Service

Botomic provides options trading automation software that runs locally on your device and connects to your existing brokerage account through their official API.

Botomic is not a broker-dealer, investment advisor, or financial services provider. We do not execute trades on your behalf, hold your funds, or have access to your brokerage account. All trading activity occurs directly between you and your broker.

3. Disclaimer

As with any software, errors may occur. Trading outcomes also depend on market conditions, broker execution, and your configured settings. You are solely responsible for your trading strategies and their results. Botomic is not liable for any trading losses.

4. No Investment Advice

The Service is provided for informational and automation purposes only. Nothing in our Service constitutes financial, investment, legal, or tax advice.

We do not provide recommendations regarding the purchase or sale of any securities. Any trading strategies, parameters, or configurations you use are entirely your own decisions.

You should consult with a qualified financial advisor before making any investment decisions.

5. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Have a valid brokerage account that supports API access
  • Comply with all applicable laws and regulations in your jurisdiction

You are responsible for ensuring that your use of the Service complies with all laws applicable to you.

6. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscriptions and Billing

Access to the Service requires a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase.

  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • We reserve the right to change pricing with reasonable notice

8. Free Trial

We may offer a free trial period for new users. Free trials require a valid payment method. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable fee.

9. Refunds

Subscription charges are refundable within 7 days of the initial subscription charge only. Refunds are not available for subsequent billing periods or renewals. When you cancel your subscription, you will retain access to the Service until the end of your current billing period.

One-time lifetime license purchases are non-refundable.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials or allow others to access your account
  • Use the Service to develop a competing product or service
  • Resell, redistribute, or sublicense access to the Service

11. Intellectual Property

The Service, including all content, features, and functionality, is owned by Botomic and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial trading activities, subject to these Terms.

12. Third-Party Services

The Service may integrate with or link to third-party services, including your brokerage. We are not responsible for the availability, accuracy, or content of any third-party services. Your use of third-party services is subject to their respective terms and conditions.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements or expectations
  • Any errors in the Service will be corrected
  • The Service will be compatible with your broker or trading environment

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTOMIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Trading losses or missed trading opportunities
  • Business interruption
  • Damages arising from your use of or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Botomic and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your trading activities

16. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You remain responsible for any outstanding fees
  • Sections of these Terms that by their nature should survive termination will survive

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
